1. Our Products

Upswing® products are food supplements and are not medicines. Information on the Website is provided for general information and is not a substitute for medical advice.

Please follow the directions on the product packaging, check ingredients and allergen information before use, do not exceed the recommended daily amount and keep supplements out of the reach of children.

If you are pregnant, breastfeeding, taking medication, have a medical condition or are unsure whether a product is suitable for you, please seek appropriate healthcare advice before use.

2. Product Information & Availability

We take reasonable care to ensure that product descriptions, images, ingredients and prices are accurate. Product packaging or appearance may occasionally differ from images shown online.

All products are subject to availability. We may correct obvious errors, limit quantities or withdraw products from sale.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled goods.

3. Orders & Payment

By placing an order, you confirm that the information you provide is accurate, you are authorised to use the selected payment method and you agree to pay the amount shown at checkout.

A contract is formed when we send you confirmation that your order has been accepted.

We may decline or cancel an order where reasonably necessary, including for payment failure, suspected fraud, stock issues or obvious pricing errors.

The total price, including applicable taxes, discounts and delivery charges, will be shown at checkout before you complete your purchase.

Payments are processed by third-party payment providers. Upswing® does not directly store your full credit or debit card details.

4. Delivery

Available delivery options, charges and any free-delivery eligibility will be shown at checkout.

Delivery times are estimates unless expressly stated otherwise.

5. Subscriptions

Some Upswing® products are available as recurring subscriptions.

Before you subscribe, the product, price, billing and delivery frequency, applicable discount and any delivery charge will be shown to you.

By purchasing a subscription, you authorise recurring charges to your selected payment method according to your chosen schedule. Your subscription will continue until cancelled.

You can manage or cancel your subscription through your account or by contacting info@upswingvitamin.com.

You can cancel your subscription at any time. Cancellation will stop future renewals, but may not affect an order that has already been processed or dispatched, subject to your statutory cancellation rights.

If we make a material change to the price or terms of an existing subscription, we will provide notice where required by law.

6. Promotions

Promotions, discounts and discount codes may be subject to specific eligibility requirements, expiry dates or product restrictions and may not always be combined.

The terms shown with a particular promotion will apply to that offer.

7. Cancellations, Returns & Refunds

If you are purchasing as a consumer, you generally have the right to cancel an eligible online purchase within 14 days of receiving the goods, subject to applicable legal exceptions.

Certain sealed products may not be eligible for change-of-mind returns once opened where a legal health or hygiene exception applies.

This does not affect your rights if a product is faulty, damaged, unsafe, incorrectly supplied or not as described.

The Website, Upswing® brand and its content, including trade marks, images, graphics, videos and written materials, are owned by or licensed to Coollab Ltd unless otherwise stated.

You may use the Website for personal, non-commercial purposes. You must not copy, reproduce, commercially exploit, interfere with or misuse the Website or its content except where permitted by law.

We may restrict access where we reasonably believe the Website is being used unlawfully or in breach of these Terms.

9. Liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

We are not responsible for delays caused by circumstances outside our reasonable control. Where this materially affects your order, we will take reasonable steps to minimise the impact.

10. Changes & Governing Law

We may update these Terms from time to time. The Terms in effect when you place an order will normally apply to that purchase.

These Terms are governed by the laws of England and Wales. Nothing in these Terms affects any mandatory consumer rights or rights to bring proceedings available to you under applicable law.
